General terms and conditions (GTC) for orders via our website www.ekkula.com
In the following we would like to introduce you to our general terms and conditions, which we use as a basis for the provision of all services provided on our website www.ekkula.com. Please read these Terms and Conditions carefully before making a purchase in our online store. By placing an order in our online store, you agree to the Terms and Conditions.
1. Conclusion of contract and delivery of goods
1.1 The language(s) available for the conclusion of the contract are German and English. When ordering studio ekkula items, your contractual partner is Sophie von Loeben, Bergstr. 23, 10115 Berlin Germany.

1.2 The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button. We will confirm the receipt of your order by email immediately after sending the order. A binding contract is concluded upon receipt of the order confirmation. Please note that the goods ordered will be delivered in advance (reservation) as soon as we have received payment of the full purchase price and any shipping costs. We therefore ask you to transfer the purchase price immediately after receipt of the order confirmation, but no later than within 7 days.

1.3 You agree to the assignment of the seller's claims for payment of the purchase price to third parties, in particular to studio ekkula.

1.4 Our handbags are handmade in Uganda. Please note that, as an exception, we are not obliged to deliver the goods ordered if we have properly ordered the goods on our part but have not been delivered correctly or on time (congruent hedging transaction). A further requirement is that we are not responsible for the lack of availability of the goods and that we have immediately informed you of this fact. In addition, we must not have taken the risk of procuring the ordered goods. If the goods are not available, we will immediately reimburse you for payments already made.

1.6 We do not assume the risk of having to procure an ordered product (procurement risk). This also applies when ordering goods that are only described in terms of their type and characteristics (generic goods). We are only obliged to deliver from our stock of goods and the goods we have ordered from our suppliers. We deliver orders within Germany and, at your request, in Europe or worldwide. If working days are specified as deadlines, we understand this to mean all days from Monday up to and including Friday, with the exception of public holidays.

1.7 You will be informed about the delivery time on the respective product detail page and before placing the order.
2. Shipping
2.1 The prices listed in the offer at the time of the order apply. The prices given are final prices, which means that they include the applicable German statutory value added tax. The goods remain our property until the purchase price has been paid in full.

2.2 Shipping costs are added to the indicated product prices. You can find out more about the amount of the shipping costs in the offers. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
Since we are a small business, we only ship twice a week (Tuesdays and Saturdays). Please consider this, when placing your order.

2.3 Alternatively, you can pick up your order in Berlin Mitte after making an appointment via info@ekkula.com.
3. Payment
3.1 In principle, we offer the payment methods prepayment, credit card and PayPal. With every order we reserve the right not to offer certain payment methods and to refer to other payment methods. Please note that we only accept payments from accounts within the European Union (EU). You have to bear any costs of a money transaction.
Prepayment
If you choose payment in advance, we will send you an E-majl with our bank details and deliver the goods after receipt of payment.
Credit card
When you choose credit card in your order process, your card will be charged immediately after submitting the order.
PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, legitimize yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after placing the order. You will receive further instructions in the order process.
PayPal may offer registered PayPal customers selected according to its own criteria additional payment modalities in the customer account. However, we have no influence on the offer of these modalities; further individually offered payment modalities affect your legal relationship with PayPal. You can find more information about this in your PayPal account.

3.2 You agree that you will receive invoices and credits exclusively in electronic form.
4. Discount codes and their redemption
4.1 Discount codes can only be redeemed within the specified period and only once as part of an order process. Please note that campaign vouchers can be tied to a minimum order value.

4.2 Discount codes can only be redeemed before the order process has been completed. Subsequent crediting is not possible. The discount code cannot be transferred to third parties. Several discount codes cannot be combined with one another unless we have agreed otherwise.
5. Statutory right of withdrawal
5.1 Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods or, in the case of partial deliveries, the last delivery.
In order to exercise your right of withdrawal, you must inform Sophie v. Loeben, Bergstr. 23, 10115 Berlin, email: info@ekkula.com, by means of a clear declaration via E-mail of your decision to revoke this contract.

If you make use of this option, we will send you a confirmation of receipt of your revocation immediately (e.g. by email). To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.
Consequences of the withdrawal

If you withdraw from this contract, we will have given you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you. Under no circumstances will you be charged any fees for this repayment. We can refuse repayment until we have received the goods back or until you have provided evidence that you have sent back the goods, whichever is earlier.

5.2 You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you informed us of the cancellation of this contract. All items must be returned in their original condition and with tags still attached.
The deadline is met if you send the goods before the period of fourteen days has expired.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.
6. Return policy
6.1 Without prejudice to your statutory right of withdrawal, we grant you a voluntary right of return of 14 days from receipt of the goods. With this right of return, you can also withdraw from the contract after the 14-day cancellation period has expired (see cancellation policy above) by returning the goods to us within 14 days of receipt (the period begins on the day after receipt of the goods).

6.2 All items returned must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase. If these requirements are not met, the return of goods can be refused.

6.3 Please note that we are a very small business, so we cannot cover the cost of return postage. You will be responsible for paying for your own shipping costs for returning your item. Depending on where you live, the time it may take for the returned product to reach us may vary. You should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

If returning from outside of the EU, please make sure to classify as RETURN on the customs declaration. Otherwise, we will incur a duty charge, that will be payable by you, for not complying with returns procedure.

6.4 Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Damages and issues:
6.5 Please note that all of our handbags are handmade in Uganda and slight irregularities in size and colour may occur. Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

6.6 The beads out of which the handbags are made are purchased and inspected for quality by our artisan in Uganda. However, it can always happen that one of the beads may break. If this happens, please contact hello@ekkula.com.

Depending on availability of the products, we will either exchange the item or reimburse you, if the claim is made within 12 months after the purchasing date. After the 12 months after the purchasing date have passed, we cannot take any responsibility for the damaged bag anymore.
Exchanges:
6.7 The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for a new item of your choice.

Refunds:

6.8 Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 10 business days. 7. Dispute resolution
7.1 The European Commission provides a platform for online dispute resolution (OS), which you can find under the link to the European Commission platform. We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
